By downloading or using Simple Sets ("the App"), you agree to these Terms of Service and our Privacy Policy. You must be at least 13 years of age to use the App. If you do not agree, do not use the App.
Kyle Palmer ("Developer") grants you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control. You may not resell, sublicense, or redistribute the App or any portion of it.
The App is free to download with limited functionality. A one-time purchase ("Simple Sets Premium") unlocks unlimited songs, unlimited setlists, and local and Google Drive backup.
The App is a personal productivity tool, similar to a notes app, that stores content you choose to enter. You are solely responsible for all content you input, including songs, lyrics, chord charts, and setlists.
By using the App, you represent and warrant that:
The Developer makes no claim to content you create or enter. However, the Developer is not responsible for, and expressly disclaims all liability arising from, your use of any content that you do not have the legal right to reproduce or store, including copyrighted song lyrics owned by third parties.
It is your responsibility to ensure your use of lyrics, chord charts, or other materials complies with applicable copyright law. The App does not grant you any rights to reproduce, distribute, or publicly perform copyrighted material. This responsibility extends to any content you export, print, or share using the App's built-in features.

The Developer is not responsible for the practices, content, or availability of any third-party services.
The App is provided "as is" without warranties of any kind, express or implied. The Developer does not warrant that the App will be error-free, uninterrupted, or free of bugs, or that any data stored within the App will be free from loss or corruption.
To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data. In no event shall the Developer's total liability to you for all claims exceed the amount you paid for the App (i.e., the purchase price of Simple Sets Premium, if purchased, or zero if no purchase has been made).
Nothing in these Terms shall affect your statutory rights as a consumer under the Ontario Consumer Protection Act.
The Developer may update these Terms at any time. Material changes will be noted in the App's store listing update history. The updated Terms will be posted with a new "Last updated" date. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario, Canada.
The Developer reserves the right to terminate or suspend your licence to use the App at any time for violations of these Terms. Because your data is stored locally on your device, termination does not result in data deletion — you retain access to your locally stored content.
The Developer does not guarantee that the App will remain available, maintained, or compatible with future operating system versions. The Developer may discontinue the App at any time without notice or liability.
The Developer intends to maintain the App for the foreseeable future but reserves the right to discontinue the App. In the event of discontinuation, users will retain access to their locally stored data as per Section 11.
